- Splashy Starfish Swimming, owners, partners and employees, shall under no circumstances be held liable for any accident or similar event or the consequences thereof, occurring on the premises or any other premises used for the purposes of swimming or training, and all persons attending these classes do so at their own risk.
- No liability will be accepted for the loss of or damage to property belonging to participants or spectators whilst on the premises of Splashy Starfish Swimming or any other premises used for the purpose of these lessons.
- Fees are payable in advance for each course.
- Schedule of fees available
- If fees are not paid upfront your space in the class may be allocated to another swimmer. The outstanding fees together with the cancellation fee will be due and payable.
- Fees are not refundable under any circumstances.
- Written notification is required in the event of cancellation of this contract. Failure to comply with this requirement will result in liability for payment of the course.
- Rules and Regulations of the pool apply. Any person not complying with these rules and regulations will be asked to leave the premises. A copy of these rules and regulations will be provided on request.
- No child/ parent may be in the pool without the instructor present.
- Each course consists of (8 – 9) lessons. The duration of the lesson is 30min (Toddler and LTS) and 45min (Mini Squad) and there will be a maximum of 6 adults and 6 babies in the pool for the baby classes, max 3 in LTS and 4 in Mini Squad.
- Splashy Starfish Swimming will be closed on public holidays and other pre-scheduled holiday weekends.
- I/we hereby consent that Splashy Starfish Swimming or its appointed agent may carry out a credit inquiry and may transmit details to the credit bureau regarding my responsibility in meeting my obligations in terms of this agreement. In the event that I fail to meet my obligations with Splashy Starfish Swimming I agree that they may record the relevant details with the credit bureau.
- I/we hereby undertake and bind myself to pay any costs, including legal, tracing and collection costs which may be incurred in the recovery of any or all outstanding monies due by me. Furthermore I undertake and bind myself to pay in respect of any amount not paid by due date, interest compounded monthly, at the maximum rate permissible by law.
